The Role of the False Claims Act in Combatting Medicare & Medicaid Fraud by Drug Manufacturers

This November 2004 TAF Education Fund report, authored by Andy Schneider of Medicaid Policy, LLC, enumerates the more than $3.9 billion that had been recovered from drug manufacturers over the course of the previous 6 years as a result of just 16 cases brought by False Claims Act whistleblowers.  All six of the new cases brought within the two years prior to this report's publication, involved fraud against Medicaid, and all were initially brought to the attention of the U.S. Government by whistleblowers.  At the time of this report, over 180 False Clams Act cases against drug manufacturers were under investigation by the U.S. Department of Justice.
